Plain-Language Explainer

What are foreclosure surplus funds?

When a property is sold at a foreclosure auction, the proceeds first go toward the loan, fees and other costs. Occasionally the sale brings in more than what is owed. The extra money is the surplus.

Whether surplus funds exist, who may claim them, and how a claim must be filed all depend on the circumstances and on state and local rules. Not every former owner is owed money, and not every claim succeeds.

Services

Foreclosure surplus funds assistance.

Superior Surplus Recovery currently focuses on one thing: helping people understand and pursue potential foreclosure surplus claims. We are not a law firm and do not provide legal advice; an attorney may be needed for some claims.

What happens after a foreclosure?

In a foreclosure sale the property is sold, typically at auction. Proceeds are applied to the loan, fees and certain liens or costs in an order set by law. If money remains, it may be held by a court, trustee or other party until a valid claim is made. Who may claim, what proof is required and any deadlines differ by state and county, so a case-specific review is essential.
